Professor Phil Lee’s research was cited by a Washington Supreme Court Justice in Barlow v. Washington, 2024 WL 41531 (Wash. filed Jan. 4, 2024). Justice Raquel Montoya-Lewis, in a dissenting opinion, cited to Lee’s article “The Curious Life of In Loco Parentis at American Universities” in support of her argument that a university’s tort liability should be based on something other than land possessor duties because university students are more than just business invitees of their institutions.
